STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty

 

AN ACT relative to the limited immunity of pharmacists.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Section; Pharmacists; Limited Immunity; Class Actions.  Amend RSA 318 by inserting after section 29-d the following new section:

318:29-e  Limited Immunity; Class Actions.  A pharmacist acting in good faith and without gross negligence, shall not be subject to civil liability for injury, death, or loss to person or property in class action litigation where the pharmacist's only actions were in compliance with the laws and rules adopted by the board pertaining to the practice of pharmacy and in effect at the time the actions occurred.  

2  Effective Date.  This act shall take effect January 1, 2021.
