AMENDED ANALYSIS
This bill prohibits flavors from being added to e-liquids or other vaping products for any person under age 21. This bill prohibits flavors other than menthol and tobacco for cartridges used in e-cigarettes and other vaping devices for all persons.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twenty
AN ACT prohibiting the use of flavors in vaping products.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Section; Youth Access to Tobacco Products; Flavors in E-Liquids. Amend RSA 126-K by inserting after section 4-a the following new section:
126-K:4-b Flavors Prohibited in E-Liquids.
I. Flavors shall be prohibited in e-cigarettes and other vaping products for any person under age 21.
II. For cartridges used in e-cigarettes and other vaping devices, all flavors other than menthol and tobacco shall be prohibited for all persons. Refillable tanks shall be exempted from the prohibition under this paragraph.
2 New Section; Alcoholic Beverages; Tobacco Products; Flavors in E-Liquids. Amend RSA 175 by inserting after section 5-b the following new section:
175:5-c Flavors Prohibited in E-Liquids.
I. Flavors shall be prohibited in e-cigarettes and other vaping products for any person under age 21.
II. For cartridges used in e-cigarettes and other vaping devices, all flavors other than menthol and tobacco shall be prohibited for all persons. Refillable tanks shall be exempted from the prohibition under this paragraph.
3 Effective Date. This act shall take effect January 1, 2021.
