This bill requires a person who files a notice of intent to cut timber with assessing officials to also notify property abutters of the intent to cut.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty

 

AN ACT relative to notification to abutters of an intent to cut timber.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Paragraph; Forest Conservation and Taxation; Notice to Abutters of Intent to Cut.  Amend RSA 79:10 by inserting after paragraph II the following new paragraph:

III.  Any owner required to file an intent to cut under this section shall also provide written notice of the intent to cut to all abutters to the property, as indicated in the city and town records for cities and incorporated towns or county records for unincorporated towns or unorganized places.  Such notice shall be provided by verified mail, as defined in RSA 21:53.  In this paragraph, "abutter" means any person who owns property immediately adjacent and contiguous to the property on which the timber cut will take place.

2  Timber Harvesting; Notice of Intent to Cut and Report of Wood Cut.  Amend RSA 227-J:5 to read as follows:

227-J:5  Notice of Intent to Cut and Report of Wood Cut.  Pursuant to RSA 79:10 and [11] RSA 79:11, any owner, as defined in RSA 79:1, II, conducting a cutting operation shall file an intent to cut with the appropriate assessing officials and property abutters and shall file a report of wood cut with the assessing officials.  Pursuant to RSA 79:10, I(d), the intent to cut form as signed or properly noted as being signed by the assessing officials or the certificate issued by the department of revenue administration shall be posted prior to starting a cutting operation.  Failure to comply with these requirements and those contained in RSA 79 may result in penalties to the owner or any other person doing the cutting, or both, under RSA 79.

3  Effective Date.  This act shall take effect 60 days after its passage.
