STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty

 

AN ACT requiring the adoption of vehicle emissions standards based on the California clean car standards.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Section; Adoption of California Air Resources Board Standards.  Amend RSA 125-C by inserting after section 21 the following new section:

125-C:22  Adoption of California Air Resources Board Standards.

I.(a)  On or before December 31, 2020, the commissioner of the department of environmental services shall adopt rules, in accordance with the provisions of RSA 541-A and RSA 125-C, to implement the light duty motor vehicle emission standards of the state of California Air Resources Board pursuant to Title 13 of the California Code of Regulations and promulgated under the authority of Division 26 of the California Health and Safety Code.  Such regulations shall be applicable to motor vehicles with a model year of 2009 and later.  Nothing in this section shall limit the commissioner's authority to regulate motor vehicle emissions for any other class of vehicle.

II.  Rules adopted pursuant to this section shall not include requirements for the sale of zero emissions vehicles (ZEV) or other related provisions of the referenced California standards.

III.  As part of the state's implementation plan under the federal Clean Air Act, the commissioner of the department of environmental services may establish a program to allow the sale, purchase, and use of motor vehicles which comply with any rules adopted by the commissioner under paragraph I for purposes of generating any emission reduction credits under said act.  Nothing in this section shall prohibit the commissioner of the department of environmental services from establishing a program to require the sale, purchase, and use of motor vehicles which comply with any rules adopted by the commissioner under paragraph I.

2  Effective Date.  This act shall take effect 60 days after its passage.

METHODOLOGY:

This bill requires adoption of vehicle emissions standards based on the California Clean Car Standards.  The Department of Environmental Services (DES) indicates compliance with federal motor vehicle emissions regulations is enforced by federal agencies, including the EPA and National Highway Traffic Safety Administration.  States that adopt the California Low Em mission Vehicle Program pursuant to Section 177 of the Clean Air Act must take on that responsibility.  The DES assumes the responsibility would fall to either Environmental Services or the Department of Safety, Division of Motor Vehicles.   DES assumes one additional full-time Program Specialist position would be necessary to perform data collection, tracking, analysis and compliance assurance.  The salary, benefits and other expenses for this position would be approximately $92,000 in FY 2021, $94,000 in FY 2022 and $98,000 in FY 2023.

 

Additional resources may also be needed for enforcement, however the bill does not provide for a specific enforcement mechanism.  The Department assumes the additional expenditures would be a cost to the general fund as current funding in the Air Resources Division would not be sufficient to cover this ongoing expense.
