STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty

 

AN ACT relative to the penalty for carnival or amusement ride operators.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Carnival-Amusement Operators; Penalty.  Amend RSA 321-A:9 to read as follows:

321-A:9  Penalty. Any person [convicted of operating] who operates a carnival or amusement ride without having first registered it with the commissioner, as provided in RSA 321-A:5, or [violating] who violates the rules adopted by the commissioner, as provided in RSA 321-A:2, shall be guilty of a violation if a natural person, or guilty of a misdemeanor if any other person.  Any person aggrieved by a violation of this section shall have a private right of action against the carnival or amusement ride operator.  Any operator or owner who operates after a suspension, as provided in RSA 321-A:7, shall be guilty of a violation for each day of illegal operation.  This section shall not be interpreted to abrogate any common law rights.

2  Effective Date.  This act shall take effect 60 days after its passage.
