AN ACT relative to the scanning of driver licenses and nondriver identification cards.

This bill establishes an exemption to the prohibition against scanning, recording, retaining, or storing information collected from drivers' licenses.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty

 

AN ACT relative to the scanning of driver licenses and nondriver identification cards.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Paragraph; Drivers' Licenses; Prohibitions.  Amend RSA 263:12 by inserting after paragraph X the following new paragraph:

XI.  Nothing in this section shall prohibit the scanning, recording, retaining, or storing of information obtained from any driver's license or nondriver's identification card collected with the driver's license or nondriver's identification card holder's consent for legitimate business purposes, provided that such practice is expressly disclosed to the holder of the driver's license or nondriver's identification card.  An authorized recipient of information obtained under this paragraph may not sell, rent, transfer, or make the information available to another person for the same or for any other use.

2  Effective Date.  This act shall take effect upon its passage.
