II.  "Food service business" means a business that sells or provides beverages or food and beverages for consumption on or off the premises, and includes, but is not limited to, any restaurant, cafe, delicatessen, coffee shop, vending truck or cart, movie theater, or business or institutional cafeteria, including those operated by or on behalf of the state.  "Food service business" shall not include any health care facility required to be licensed under RSA 151:2.

149-M:62  Plastic Straw Restriction.  A food service business shall provide a single-use plastic straw to a customer only when explicitly requested by the customer, or when a customer selects a single-use plastic straw from a self-service dispenser.  This section shall be exempt from RSA 149-M:5.

3  Effective Date.  This act shall take effect one year after its passage.
