AN ACT relative to the presence of a fire department at a class B fireworks display.

ANALYSIS

 

This bill permits municipalities that issue permits to display fireworks to have local fire department personnel inspect display sites and provide a presence at displays of fireworks.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty

 

AN ACT relative to the presence of a fire department at a class B fireworks display.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Public Safety; Fireworks; Local Option.  Amend RSA 160-C:6 to read as follows:

160-C:6  Local Option.

I.  Any municipality in the state, by action of its local legislative body or local governing body, may vote to allow or to prohibit, within that municipality, the issuance of permits or licenses to sell permissible fireworks or the display or possession of permissible fireworks.  If the municipality has voted to prohibit the issuance of permits or licenses or the display or possession of permissible fireworks prior to the effective date of this section, such decision shall remain in effect unless subsequent action is taken under this section.

II.  In any municipality that votes to allow, within that municipality, the issuance of permits for the display of permissible fireworks, the local fire department may inspect the site of the display.  The municipality shall determine whether to have the presence of fire department personnel and extinguishing equipment at the display and if so, how long the presence shall last.

2  Public Safety; Fireworks; Fireworks Inspector.  Amend RSA 160-C:17:1-a to read as follows:

I-a.  Except as provided in RSA 160-C:6, inspect sites and facilities for the display or storage of display fireworks, as defined in RSA 160-B:1, X.

3  Effective Date.  This act shall take effect 60 days after its passage.
