ANALYSIS

 

This bill prohibits an employer from using a failed drug test for cannabis use as grounds for terminating the employment of, or to deny promotion to, any employee.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty

 

AN ACT relative to employee drug testing.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Subdivision; Employee Drug Testing.  Amend RSA 275 by inserting after section 77 the following new subdivision:

Employee Drug Testing

275:78  Protections for Failed Drug Test for Cannabis Use.  No employer shall use a failed drug test for cannabis use as grounds for terminating the employment of, or to deny promotion to, any employee.  

2  Effective Date.  This act shall take effect 60 days after its passage.
