ANALYSIS

 

This bill establishes a fine for parking a motor vehicle other than a plug-in-hybrid vehicle or battery electric vehicle in a parking space that has a public electric vehicle charging station.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty

 

AN ACT relative to electric vehicle parking spaces.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Paragraph; Electric Vehicle Charging Stations; Prohibitions and Restrictions.  Amend RSA 236:134 by inserting after paragraph III the following new paragraph:

IV.  Any person who violates the parking restrictions in paragraph I shall be guilty of a violation and fined a minimum of $100 of which 20 percent is payable to the town or city where the violation occurred.

2  New Subparagraph; Stopping, Standing, or Parking Prohibited in Specified Places.  Amend RSA 265:69 by inserting after subparagraph I(m) the following new subparagraph:

(n)  In any space equipped with an electric vehicle charging station on a public way, unless such person is operating a plug-in-hybrid electric vehicle as defined in RSA 236:132, V or battery electric vehicle as defined in RSA 236:132, I.  Any person who violates the provisions of this subparagraph shall be fined a minimum of $100 of which 20 percent is payable to the town or city where the violation occurred.

3  Effective Date.  This act shall take effect 30 days after its passage.

METHODOLOGY:

This bill establishes a violation level offense and a minimum of $100 fine (of which 20% shall be payable to municipality where violation occurred) for improperly parking in spaces designated for electric vehicles.  There is no method to determine how many charges, if any, would be brought as a result of bill to determine the fiscal impact on state and local revenues.  

 

The Judicial Branch estimates average cost of violation level cases to be $52 in FY 2021 and $54 in FY 2022.  It should be noted that average case cost estimates for FY 2021 and FY 2022 are based on data that is more than ten years old and does not reflect changes to the courts over that same period of time or the impact these changes may have on processing the various case types.  Additionally, the Department of Safety expects it would incur minimal (under $10,000) in costs in FY 2021 relative to system and uniform fine schedule changes needed to implement this bill.
