ANALYSIS

 

This bill requires that one year after implementation of an electronic filing system by the secretary of state, the registration forms and fee and expense reports of lobbyists shall be filed electronically with the secretary of state and made available as public records on the department of state's Internet site.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty

 

AN ACT requiring electronic filing of lobbyist's forms and statements.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Lobbyist Registration; Secretary Of State.  Not later than January 1, 2021, the secretary of state shall implement an electronic record keeping system for submission of lobbyist registration forms and fee and expense reports under RSA 15 and for the availability of such forms and reports to the public on the secretary of state's Internet site.  The secretary of state may continue to accept paper filing of such forms and reports for one year after implementation of the electronic record keeping system.

2  Lobbyists; Statements.  Amend the introductory paragraph of RSA 15:6, I to read as follows:

I.  Each lobbyist shall electronically file with the secretary of state itemized statements under oath of:

3  Electronic Form Required.  Amend the introductory paragraph of RSA 15:6, V to read as follows:

V.  The lobbyist statement shall be [in the] completed on the electronic form prescribed by the secretary of state[, may be in paper or electronic form,] and shall include at a minimum:

4  Electronic Signature.  Amend RSA 15:6, V(h) to read as follows:

(h)  The following statement followed by a line for each person filing the form to electronically sign and date the form:  "I have read RSA 15, RSA 15-B, RSA 14-C, and RSA 664 and hereby swear or affirm that the foregoing information is true and complete to the best of my knowledge and belief."

5  Lobbyist Statements; Electronic Record Keeping System.  Amend RSA 15:6, VI to read as follows:

VI.  The secretary of state shall maintain the statements required by this section for 6 years from the date of filing, after which time the statements may be destroyed.  The public information on the forms shall be available to the public in the form of [a photocopy or] an electronic record.  The secretary of state shall[, as soon as is practical, implement] utilize an electronic record keeping system that makes lobbyist registration forms and fee and expense reports available to the public through the Internet.  

6  Effective Date.  

I.  Sections 2-5 of this act shall take effect January 1, 2022.

II.  The remainder of this act shall take effect upon its passage.

AS INTRODUCED

 

AN ACT requiring electronic filing of lobbyist's forms and statements.

METHODOLOGY:

This bill requires the Department of State to create an on-line module for lobbyist registration and reporting by January 1, 2021, with mandatory on-line filing by January 1, 2022.  The Department indicates the lobbyist module is currently under construction using existing funds and no additional expenditures are anticipated.
