1 New Section; Sale of Inventory During State of Emergency. Amend RSA 178:20-a by inserting after section 20-a the following new section:

178:20-b Sale of Inventory During a Closure Due to a State of Emergency. A licensee that sells beer or cider from kegs for on-site consumption and, due to a statewide public health state of emergency declared pursuant to RSA 4:45, is not offering on-site consumption or the volume of on-site consumption is significantly reduced, may sell its existing inventory of kegged beer or cider via suitable containers, such as cans filled and sealed on-site or refillable containers, under similar regulations permitted for beverage manufacturers under RSA 178:12, nano breweries under RSA 178:12-a, and brew pubs under RSA 178:13. Cans and containers may only be filled by the licensee and the licensee's employees. In this section, "refillable container" means a container designed to hold beer or cider for commercial sale, including containers where the beverage does not match the labeling on the container.

2 Effective Date. This act shall take effect upon its passage.
