1 New Subdivision; Commission to Study the Adoption of Remote Online Notarization in New Hampshire. Amend RSA 455 by inserting after section 17 the following new subdivision:

Commission to Study the Adoption of Remote Online Notarization in New Hampshire

455:18 Commission to Study the Adoption of Remote Online Notarization in New Hampshire.

I. There is established a commission to study the adoption of remote online notarization in New Hampshire.

II. The members of the commission shall be as follows:

(a) One member of the senate, appointed by the president of the senate.

(b) Two members of the house of representatives, appointed by the speaker of the house of representatives.

(c) The secretary of state, or designee.

(d) A representative of the Mortgage Bankers and Brokers Association of New Hampshire, appointed by the association.

(e) A representative of the New Hampshire Bankers Association, appointed by the association.

(f) A representative of the New Hampshire Credit Union League, appointed by the association.

(g) A representative of the New Hampshire City and Town Clerks' Association, appointed by the association.

(h) A representative of the New Hampshire Association of Counties, appointed by the association.

(i) A representative of the New Hampshire Association of Realtors, appointed by the association.

(j) A member of the New Hampshire Bar Association who deals in probate matters, appointed by the association.

(k) A member of the New Hampshire Bar Association who deals in real estate transfers, appointed by the association.

(l) A member of the New Hampshire Association of Title Companies, appointed by the association.

III. Legislative members of the commission shall receive mileage at the legislative rate when attending to the duties of the commission.

IV. The commission shall study the possible implementation of remote online notarization in New Hampshire including, but not limited to:

(a) Remote online notarization laws in other states, including model legislation.

(b) Assessment of the infrastructure for supporting the implementation of remote online notarization in New Hampshire.

V. The commission shall solicit information from any person or entity the commission deems relevant to its study.

VI. The members of the commission shall elect a chairperson from among the members. The first meeting of the commission shall be called by the senate member. The first meeting of the commission shall be held within 45 days of the effective date of this section. Six members of the commission shall constitute a quorum.

VII. The commission shall report its findings and any recommendations for proposed legislation to the president of the senate, the speaker of the house of representatives, the senate clerk, the house clerk, the governor, and the state library on or before November 1, 2020.

2 Repeal. RSA 455:18, relative to the commission to study the adoption of remote online notarization in New Hampshire, is repealed.

3 Effective Date.

I. Section 2 of this act shall take effect November 1, 2020.

II. The remainder of this act shall take effect upon its passage.
