STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty

 

AN ACT establishing a committee to study the effectiveness of outdoor therapy, art therapy, and music therapy as alternative covered treatments for individuals with post-traumatic stress disorder and substance abuse disorders.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Committee Established.

I.  There is established a committee to study the effectiveness of outdoor therapy, art therapy, and music therapy as alternative covered treatments for individuals with post-traumatic stress disorder and substance abuse disorders.

II.  The members of the committee shall be as follows:

(a)  Two members of the senate, appointed by the senate president.

(b)  Five members of the house of representatives, appointed by the speaker of the house of representatives.

III.  Members of the committee shall receive mileage at the legislative rate when attending to the duties of the committee.

IV.(a)  The duties of the committee shall include, but not be limited to, the following:

(1)  Reviewing the existing literature, studies, and legislation from other states that support the use of outdoor, art, and music therapy to treat individuals with post-traumatic stress disorder and substance abuse disorders.

(2)  Identifying the barriers for individuals to access such programs, including the availability of relevant licensed professionals, fees with regard to state parks, lands, and recreational facilities, access to museums, and relevant musical programs and classes.

(3)  Determining the cost to state agencies and private businesses if current fees and charges were waived for individuals in treatment for post-traumatic stress disorder or substance abuse disorders.

(4)  Considering private insurance coverage of appropriately approved outdoor, art, and music therapies and whether such coverage would reduce the costs of current medical treatments for those with post-traumatic stress disorder and substance abuse disorders.

(b)  The committee may solicit input from the department of health and human services, the department of natural and cultural resources, the department of education and the department of corrections as to what outdoor, arts, and music programs are currently available that might be expanded to individuals with post-traumatic stress disorder and substance abuse disorders.

V.  The members of the study committee shall elect a chairperson from among the members.  The first meeting of the committee shall be called by the first-named senate member.  The first meeting of the committee shall be held within 45 days of the effective date of this section.  Four members of the committee shall constitute a quorum.

VI.  The committee shall report its findings and any recommendations for proposed legislation to the president of the senate, the speaker of the house of representatives, the senate clerk, the house clerk, the governor, and the state library on or before November 1, 2020.

2  Effective Date.  This act shall take effect upon its passage.
