1 Retirement System; Protection Against Fraud. Amend RSA 100-A:27 to read as follows:

100-A:27 Protection Against Fraud .

Any person who shall knowingly make any false statement or shall falsify or permit to be falsified any record or records of this retirement system in any attempt to defraud the system as a result of such act, shall be guilty of a class B felony if a natural person, or guilty of a felony if any other person.

Should any change or error in the records result in any member or beneficiary receiving from the system more or less than he would have been entitled to receive had the records been correct, the board of trustees shall have the power to correct such error, and to adjust as far as practicable the payments in such a manner that the actuarial equivalent of the benefit to which such member or beneficiary was correctly entitled shall be paid.

2 Effective Date. This act shall take effect 60 days after its passage.

I.(a) Any person who shall knowingly make any false statement or shall falsify or permit to be falsified any record or records of this retirement system in any attempt to defraud the system as a result of such act, shall be guilty of a class B felony if a natural person, or guilty of a felony if any other person.

(b) Should any change or error in the records caused by any aforementioned fraud result in any member or beneficiary receiving from the system more than such member or beneficiary would have been entitled to receive had the records been correct, the board of trustees shall have the power to correct such error, and to adjust as far as practicable the payments in such a manner that the actuarial equivalent of the benefit to which such member or beneficiary was properly entitled shall be paid.

II. Should any change or error in the records not caused by a member or beneficiary's fraudulent conduct result in any such member or beneficiary receiving from the system less than he or she would have been entitled to receive had the records been correct, the board of trustees shall have no power to correct such error detrimental to the member or beneficiary, and shall provide the member or beneficiary the actuarial equivalent of the benefit to which he or she reasonably relied upon.

2 Effective Date. This act shall take effect 60 days after its passage.
