STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twenty
AN ACT relative to reimbursement to cities and towns from the state of New Hampshire.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Aid to Assisted Persons; Liability for Support and reimbursement from the State; Suspension. RSA 165:20-c, relative to liability for support and reimbursement from the state, shall be suspended for the biennium ending June 30, 2021.
2 Reimbursement From the State of New Hampshire. Amend RSA 165:20-c, I to read as follows:
I. If any person receiving general assistance from a town or city under the provisions of this chapter is deemed to be eligible for assistance under the provisions of RSA 167, the commissioner of health and human services shall reimburse such town or city the amount of assistance provided by the town or city as a result of [the commissioner of health and human services'] unreasonable delays in processing [within] the application which exceed the federally mandated time periods.
I. Section 2 of this act shall take effect July 1, 2021.
II. The remainder of this act shall take effect upon its passage.

METHODOLOGY:
This bill suspends for the FY 2020/21 biennium RSA 165:20-c, which requires the Department of Health and Human Services to reimburse municipalities, in the aggregate, for up to $100,000 per year in the event that cities or towns provided public assistance as a result of the Department's delay in processing within federally mandated time periods. The bill further clarifies that, when not suspended, the statute will allow municipalities to seek reimbursement only as a result of "unreasonable" delays in processing which exceed the federally mandated time periods. As the bill's suspension of RSA 165:20-c is effective upon passage and may take effect during FY 2020, the bill will reduce state expenditures and local revenues by up to $100,000 per year in FY 2020 and FY 2021.
