STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twenty
AN ACT relative to winter highway maintenance exemptions.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Equipment of Vehicles; Exception for Winter Highway Maintenance. Amend RSA 266:21 to read as follows:
266:21 Exception for Winter Highway Maintenance.
I. Any construction equipment and motor vehicles used for the winter maintenance of ways that are owned, leased, or rented by the state or any political subdivision of the state are exempt from the limitations in RSA 266:18, RSA 266:11, and RSA 266:12.
II. Any intrastate driver engaged in emergency winter highway maintenance for the state or a political subdivision, shall be exempted from 49 C.F.R. 395.3, adopted under RSA 266:72-a, only while engaged in emergency winter highway maintenance for the state or a political subdivision. Any such driver shall be subject to the requirements of 49 C.F.R. 395.3, adopted by RSA 266:72-a, when he or she returns to duty for any motor carrier.
2 Effective Date. This act shall take effect upon its passage.

METHODOLOGY:
This bill exempts intrastate drivers from the maximum driving time requirements while engaged in emergency winter highway maintenance for the State or a political subdivision, which may put the State out of compliance with federal regulations. While the bill does not result in any programmatic changes or any fees or fines to the State, the Department of Safety states the Federal Motor Carrier Safety Administration advises non-compliance could result in a loss of federal revenue to the State.
