STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twenty
AN ACT providing for premium-free insurance to persons who donate a kidney.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Section; Health and Human Services; Health Insurance for Kidney Donors. Amend RSA 126-A by inserting after section 18-b the following new section:
126-A:18-c Health Insurance for Kidney Donors; Fund Established.
I. Any New Hampshire resident who donates a kidney as a live kidney donor on or after the effective date of this section shall be eligible after such donation to receive health insurance through the New Hampshire state health insurance marketplace with the cost of the premium paid for by the state for the duration of such donor's life. The department shall be responsible for the payment of all premiums in connection with the insurance and neither the donor nor his or her employer shall be liable for the premiums.
II. Insurance and premium payments provided pursuant to this section shall be made for the highest level of services available through a gold level plan available on the New Hampshire health insurance marketplace, and shall include prescription drug coverage.
III. Such insurance premium payment shall be paid from the kidney donor insurance fund established under paragraph IV.
IV. There is hereby established in the state treasury the kidney donor insurance fund. The fund shall consist of all moneys appropriated for its purpose, all moneys transferred to the fund, all moneys required by any other provision of law to be credited to the fund, any grants, gifts or bequests received by the department for the purposes of the fund, and any interest earnings which may accrue from the investment of moneys in the fund.
V. The fund shall be nonlapsing and continually appropriated to the department of health and human services and shall be available for all costs of supplying kidney donors with health insurance under section.
2 New Subparagraph; Application of Receipts; Kidney Donor Insurance Fund. Amend RSA 6:12, I(b) by inserting after subparagraph (358) the following new subparagraph:
(359) Moneys deposited in the kidney donor insurance fund established in RSA 126-A:18-c.
3 Effective Date. This act shall take effect 60 days after its passage.

METHODOLOGY:
This bill provides that any New Hampshire resident who donates a kidney shall have his or her health insurance premiums for a gold level plan in the state health marketplace paid for life by the State. The bill establishes the Health Insurance for Kidney Donors Fund and would require the Department of Health and Human Services to pay insurance premiums from the fund for a gold level plan available on the New Hampshire Health Insurance Marketplace. The Department assumes:
The Department indicates the cost of implementing this benefit is indeterminable because there is no way to determine: how many New Hampshire residents will donate a kidney, the number of individuals who will donate a kidney after the effective date of the bill and choose to become New Hampshire residents, the length of time the Department would be paying the insurance premiums, or what the cost of a gold level plan will be in future years.
The Insurance Department assumes the bill would have no impact on premium tax revenue and no impact on the New Hampshire Insurance Department Administrative Fund.
It is assumed the fiscal impact of the bill would not occur until FY 2021.
