Floor Amendment to HB 113

 

Amend the bill by replacing section 2 with the following:

 

2  New Paragraph; Protective Legislation; Wages.  Amend RSA 275:43 by inserting after paragraph V the following new paragraph:

V-a.  An employee who leaves in good standing, or whose termination is the result of a layoff, shall be paid for unused vacation hours no later than the next regular pay period.  If the termination is the result of a change of business ownership, the prior employer shall, upon completion of the transfer of ownership, pay the employee's unused vacation wages or transfer the employee's unused vacation hours to the new employer.

AMENDED ANALYSIS

This bill requires an employer to pay an employee for earned but unused vacation time.  The bill also provides that if the termination is the result of a change of business ownership, the prior employer shall pay the employee's unused vacation wages or credit the unused vacation hours to the new employer.
