Amendment to HB 434
Amend section 2 of the bill by replacing paragraph II with the following:
II. The purpose of this act is to ensure, to the maximum extent permitted by the Supremacy Clause, that public funds are not used to subsidize abortion.
Amend RSA 132:44 as inserted by section 3 of the bill by replacing it with the following:
132:44 Use of School Tuition and Fees for Abortion Prohibited. No part of any tuition or fees paid to a public institution of higher education shall be used in any way to pay for an abortion, provide or perform an abortion, make a referral for abortion, or provide facilities for an abortion.
Amend RSA 132:48 as inserted by section 3 of the bill by replacing it with the following:
132:48 Construction. The scope of this subdivision is limited to those abortions not received by Medicaid recipients and reimbursed or otherwise financed pursuant to the state’s Medicaid plan. Nothing in this subdivision shall be construed as creating or endorsing a statutory right, or recognizing a constitutional right, to abortion or to federal or state funds for abortion.
