Floor Amendment to SB 62
Amend the bill by replacing all after the enacting clause with the following:
1 New Section; Disposal of E-Cigarettes. Amend RSA 149-M by inserting after section 28 the following new section:
149-M:28-a Disposal of Electronic Cigarette Devices.
I. A manufacturer of e-cigarettes, as defined by RSA 175:1, XXXI-a, shall inform the commissioner of any devices it offers for sale in New Hampshire that contain lithium-ion batteries, lead, nicotine, or any other materials defined as hazardous waste in RSA 147-A:2, VII. The commissioner shall adopt rules under RSA 541-A regarding procedures and requirements for the reporting of such information to the department.
II. The department shall make available educational materials for use by municipalities on potential e-cigarette hazardous waste and its disposal, and it shall make available guidance to manufacturers and to retailers and other sellers of e-cigarettes on voluntary programs for the collection and recycling of e-cigarette devices containing lithium-ion batteries, lead, nicotine, or other hazardous waste, to the extent such programs exist.
2 Effective Date. This act shall take effect January 1, 2022.

AMENDED ANALYSIS
This bill requires manufacturers of e-cigarettes to inform the department of environmental services of hazardous waste from such e-cigarettes and requires the department of environmental services to adopt rules relative to the disposal of such e-cigarettes.
