Committee of Conference Report on HB 1011-FN, relative to the penalty for criminal mischief.
Recommendation:
That the House recede from its position of nonconcurrence with the Senate amendment, and
That the Senate recede from its position in adopting its amendment to the bill, and
That the Senate and House adopt the following new amendment to the bill as passed by the House, and pass the bill as so amended:
Amend the bill by replacing all after the enacting clause with the following:
1 Destruction of Property; Criminal Mischief. Amend RSA 634:2, VI to read as follows:
VI. Any person who is found guilty of criminal mischief under paragraph III of this section because he or she has vandalized, defaced, destroyed, tampered with, or made any other unauthorized alteration, whether permanent or temporary, [on] to public property, shall be guilty of a [violation and shall also make restitution for any damage he or she has caused] class A misdemeanor.
2 New Paragraph; Destruction of Property; Criminal Mischief. Amend RSA 634:2 by inserting after paragraph VI the following new paragraph:
VI-a. Any person who is found guilty of criminal mischief under this section because he or she has vandalized, defaced, destroyed, tampered with, or made any other unauthorized alteration, whether permanent or temporary, to public property shall be ordered to pay restitution for any damage he or she has caused.
3 Effective Date. This act shall take effect upon its passage.
