STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Two

 

AN ACT requiring businesses to use the federal E-Verify system of the United States Citizenship and Immigration Services.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Employment of Undocumented Workers Prohibited; E-Verify.  Amend RSA 275-A:4-a to read as follows:

275-A:4-a  Employment of Undocumented Workers Prohibited.  No employer may employ any employee without verifying employment eligibility through the E-Verify system of the United States Citizenship and Immigration Services and obtaining documentation showing the employee's eligibility to work in the United States.  The employer shall maintain such documentation for the period required by federal law.  Acceptable documentation of eligibility to work in the United States shall include documents required by federal law or supporting documentation that satisfies the requirement of federal law.

2  Effective Date. This act shall take effect January 1, 2023.
