STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Two

 

AN ACT relative to the right to submit evidence and testimony in family court proceedings.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Section; Judicial Branch Family Division; Right to Present Evidence and Testimony.  Amend RSA 490-D by inserting after section 3 the following new section:

490-D:3-a  Right to Present Evidence and Testimony.  The parties in any family court proceeding shall have the right to present evidence and testimony.  This right shall not be limited by the presiding judge, magistrate, or marital master, or by the New Hampshire rules of evidence or the rules of the circuit court family division.

2  Effective Date.  This act shall take effect 60 days after its passage.
