Amendment to HB 1376

 

Amend the bill by replacing section 1 with the following:

 

1  Education Freedom Accounts; Responsibilities of the Scholarship Organization; Parents of Students with Disabilities.  Amend RSA 194-F:4, III to read as follows:

III.  The scholarship organization shall ensure that parents of students with disabilities, whose children with disabilities are enrolled in a nonpublic elementary or secondary school as defined in 20 U.S.C. sections 1401(6) and 1401(27) receive notice that participation in the EFA program is a parental placement under 20 U.S.C. section [1412] 1412(a)(10)(A), Individuals with Disabilities Education Act (IDEA), along with an explanation of the rights that parentally placed students [possess] have under IDEA and any applicable state laws.  The scholarship organization shall provide parents of students with disabilities who are not enrolled in a private elementary or secondary school an explanation of the rights that such students have under IDEA and any applicable state laws.
