AN ACT relative to motor vehicle title exemptions.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Certificates of Title and Registration of Vehicles; Exempted Vehicles.  Amend RSA 261:3, I(k) to read as follows:

(k) Any motor vehicle whose manufacturer's model year is [before the year 2000] 7 or more years old, except heavy trucks and truck-tractors whose gross vehicle weight exceeds 18,000 pounds.

2  Effective Date.  This act shall take effect 60 days after its passage.

METHODOLOGY:

This bill amends RSA 261:3, which outlines the vehicles exempted from requiring a certificate of title, by changing the requirement from model year of 2000 or newer to when the vehicle is 7 years old or older. Based on these changes, any vehicle that is 7 years old or older, except heavy trucks and truck-tractors whose gross vehicle weight exceeds 18,000 pounds, will not be required to have a certificate of title regardless of circumstances to include salvage vehicles. Also, vehicles that have been repaired after being deemed a total loss will not be required to complete a salvage inspection or obtain a salvage title if it meets the new criteria. The mechanism for recognizing a vehicle as having prior damage such as flood, salvage, or odometer rollbacks will be removed for vehicles fitting the new criteria as well.

 

The Department of Safety has provided the following information relative to title fees collected over the last three calendar years on vehicles with a model year between 2000 and 2015:

This data suggests a three-year rolling average of $5,380,975 of state and $430,478 local revenue decrease per year. Also, pursuant to RSA 235:23 (“Apportionment A”), 12 percent of road toll and motor vehicle fees collected are distributed to municipalities, therefore, under this bill state expenditures and local revenue would decrease by $645,717 per year beginning FY 2024.
