1 New Paragraph; Solid Waste Management; Rulemaking; Construction and Demolition Debris Prohibited. Amend RSA 149-M:7 by inserting after paragraph XIV the following new paragraph:

XIV-a. Prohibiting any landfill permitted by the department from accepting construction and demolition debris.

2 Solid Waste Management; Penalties. Amend RSA 149-M:15, IV to read as follows:

IV. any person who violates any of the provisions of this chapter, or any rule adopted or order issued under this chapter, or any condition in a permit issued under this chapter shall be subject to a civil penalty not to exceed $25,000 for each violation, or for each day of a continuing violation.

3 Effective Date. This act shall take effect January 1, 2023.

(a) Except as provided in subparagraph (b), any person who violates any of the provisions of this chapter, or any rule adopted or order issued under this chapter, or any condition in a permit issued under this chapter shall be subject to a civil penalty not to exceed $25,000 for each violation, or for each day of a continuing violation.

** (b) A landfill permit holder who violates the rules established by the department prohibiting the acceptance of construction and demolition debris for disposal in a landfill shall be subject to a civil penalty of $250 for the first offense, $2,500 for the second offense, and $25,000 for each subsequent offense.**

3 Effective Date. This act shall take effect January 1, 2023.
