STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Two

 

AN ACT establishing a limited farmers liquor manufacturer license.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Section; Limited Farmers Liquor Manufacturer License.  Amend RSA 178 by inserting after section 7 the following new section:

178:7-a  Limited Farmers Liquor Manufacturer License.

I.  A limited farmers liquor manufacturer licensee may ferment, distill, blend, age, and bottle liquor other than wine in this state produced from fruit, vegetables, herbs, and any other products grown on his or her farm or other farms in New Hampshire.  At least 65 percent of the final product shall be from products grown in New Hampshire.  A limited liquor manufacturer licensee may sell the liquor it produces to the commission for resale in this state.  

II.  No liquor manufactured, blended, or bottled in this state by a limited farmers liquor manufacturer licensee shall be sold or delivered in this state in any manner which is inconsistent with the provisions of this title.

III.  Each limited farmers liquor manufacturer distilling less than 1,000 cases of liquor per year may sell at retail at its facility for off-premises consumption any of its liquor.  Each retail sale shall be limited to one 9-liter case or less per sale.  No limited farmers liquor manufacturer shall sell more than 12 9-liter cases of liquor to any one customer in any calendar year.

IV.  A limited farmers liquor manufacturer may provide to visitors at its facility samples of liquor for tasting.  Samples shall not exceed 1/2 ounce, and shall not be provided to any person under 21 years of age.

V.  Notwithstanding paragraph III, no limited farmers liquor manufacturer shall sell at its facility any of its liquor to on-premises licensees.

VI.  Each limited farmers liquor manufacturer shall maintain records and prepare reports for the commission which shall indicate the sales made under paragraph III and shall pay to the commission monthly a fee equal to 8 percent of such sales on or before the 10th day of the month following the sale.

VII.  The commission shall adopt rules, pursuant to RSA 541-A, relative to reports of liquor manufacturers under paragraph VI.

VIII.  Each limited farmers liquor manufacturer shall have the right to transport the liquor it manufacturers, blends, or bottles in bottles or other closed containers to the state border for transportation and sale outside the state to holders of a United States basic permit issued under the Federal Alcohol Administration Act.  

2  New Subparagraph; Limited Farmers Liquor Manufacturer License.  Amend RSA 178:29, V(a) by inserting after subparagraph (2) the following new subparagraph:

(3)  Limited farmers liquor manufacturer license, $500.

3  Effective Date.  This act shall take effect July 1, 2022.

METHODOLOGY:

This bill establishes a limited farmers liquor manufacturer license.  The Liquor Commission indicates the existing fee to acquire a liquor manufacturer’s license is $1,692 per licensing year.  This bill would establish a limited farm manufacturing license for $500 per licensing year.  The Commission is not able to predict how many farms will apply for this license type and is unable to forecast the amount of sales, license fee, or tax revenue that would be collected if the bill becomes law.  The Commission states it is not certain the fee of $500 would cover the cost to administer and monitor the licensee for reporting and compliance purposes.
