This bill clarifies requirements for reciprocal licenses granted by the boards, commissions, and councils administered by the office of professional licensure and certification and establishes registration for paid feeding assistant programs.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twenty Two
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Office of Professional Licensure and Certification; Reciprocity Licensing Process. Amend RSA 310-A:1-f to read as follows:
310-A:1-f [Temporary] Reciprocity Licensing Process; Rulemaking. Notwithstanding any other state law to the contrary, the office of professional licensure and certification shall be authorized to issue [temporary] licenses to [out-of-state health care] professionals who present evidence of an active license in good standing from another jurisdiction, in accordance with rules adopted by executive director of the office of professional licensure and certification under RSA 541-A, provided that the jurisdiction's licensing requirements are substantially equivalent to New Hampshire's licensing requirements, as determined by the executive director in consultation with the boards, commissions, and councils within the office. The rules shall contain the following provisions:
I. [Health care professionals shall include those individuals licensed by the boards, councils, and commissions within the office of professional licensure and certification as set forth in RSA 310-A:1-a, who perform specified medical or ancillary services within the scope of his or her authority, as determined by the executive director.] Individuals seeking a license by endorsement pursuant to this section shall be required to undergo a criminal history records check if otherwise required for initial licensing applications for that profession.
II. [The temporary licenses shall be valid for 120 days, or until the board, council, or commission takes action on an application for full licensure, whichever happens first.] Licenses issued pursuant to this section shall be for the same duration of and subject to the same renewal requirements established by the licensing body for that profession.
III. All individuals licensed under this section shall be subject to the jurisdiction of the state licensing body for that profession.
2 New Section; Paid Feeding Assistant Programs. Amend RSA 326-B by inserting after section 27 the following new section:
326-B:27-a Paid Feeding Assistant Programs. The office of professional licensure and certification is authorized to approve paid feeding assistant programs in accordance with rules adopted by the executive director of the office of professional licensure and certification, in consultation with the board of nursing, pursuant to RSA 541-A.
3 Effective Date. This act shall take effect 60 days after its passage.
