STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twenty Two
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Purpose. This legislation provides state matching funds for Federal Emergency Management Agency public assistance disaster grants and hazard mitigation grant program resulting from two presidential disaster declarations in response to July-August 2021 flood damage sustained by communities in Cheshire and Sullivan counties.
2 New Section; Disaster Relief; State Matching Funds; July and August 2021 Disaster Assistance. Amend RSA 21-P by inserting after section 37-c the following new section:
21-P:37-d Disaster Relief; State Matching Funds; July and August 2021 Disaster Assistance.
I. To supplement the Federal Emergency Management Agency (FEMA) public assistance disaster grants and hazard mitigation grants given to towns in Cheshire and Sullivan counties who sustained flood damage during the presidentially declared disasters in July and August 2021, the remaining cost to be covered by matching funds from the state and local governments shall be derived equally from state authorized funds and town funds. Both the state and the local governments shall each provide 12.5 percent of total project eligible costs.
II. The department of safety, division of homeland security and emergency management shall verify FEMA grant awards and provide assurance of amounts of funding for the state match distributed to towns to fulfill the terms of RSA 21-P:37-d.
3 Appropriation. The sum necessary to cover 12.5 percent of project eligible costs relating to public assistance disaster grants and hazard mitigation grants given to communities in Cheshire and Sullivan counties who sustained flood damage from the presidentially declared disasters during July and August 2021 shall be appropriated to the department of safety for distribution to towns. The governor shall determine if any discretionary funds appropriated in the American Rescue Plan Act of 2021, Public Law 117-2, or any other federal funds can be used for this purpose, and the department shall use such federal funds for this purpose. Any remainder shall be appropriated from the general fund. The governor is authorized to draw a warrant out of any money in the treasury not otherwise appropriated. The appropriation in this section shall be in addition to any other funds authorized, appropriated or loaned for disaster relief or storm mitigation to the department.
4 Effective Date. This act shall take effect upon its passage.

METHODOLOGY:
This bill provides matching funds from the state for Federal Emergency Management Agency public assistance disaster grants and hazard mitigation grant program resulting from two presidential disaster declarations in response to July-August 2021 flood damage sustained by communities in Cheshire and Sullivan counties.
Based on estimated federal disaster funding of $5,887,191, the Department of Safety, indicates State expenditures would increase by $735,898 in FY 2022 or 12.5% of the total and $2,438 in fiscal years 2023 through 2025. The Department states the actual timing of the distribution of funds is based on project completion and could shift between fiscal years. To the extent funds are available from the American Rescue Plan Act for this purpose, the general fund appropriation shall be reduced.
