STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twenty Two
AN ACT relative to financial assistance for municipalities affected by disasters.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Section; Homeland Security and Emergency Management; Disaster Relief Assistance for Municipalities. Amend RSA 21-P by inserting after section 37-c the following new section:
21-P:37-d Disaster Relief Assistance for Municipalities.
I. When the President of the United States declares an area a federal disaster area and a municipality has applied for federal emergency assistance from the Federal Emergency Management Administration (FEMA), the municipality may apply to the division of homeland security and emergency management for state aid in an amount not to exceed 50 percent of the non-federal share of projects eligible for costs relating to public assistance disaster grants and hazard mitigation grants. For approved applications, the division, with the approval of the fiscal committee of the general court, the governor, and the executive council, shall disburse aid to the municipality. The governor is authorized to draw a warrant for said sum out of any money in the treasury not otherwise appropriated.
II. This section shall apply to federal disasters declared on or after July 1, 2021.
III. The director of homeland security and emergency management shall administer aid under this section and may adopt administrative rules under RSA 541-A.
2 Effective Date. This act shall take effect upon its passage.

METHODOLOGY:
This bill allows for municipalities to apply to the Department of Safety for up to 50% of the non-federal share of projects eligible for costs relating to FEMA public assistance disaster grants and hazard mitigation grants, for disasters declared on or after July 1, 2021. Amounts would be disbursed by the Department to municipalities from general funds not otherwise appropriated, upon approval of the Fiscal Committee of the General Court, and Governor and Executive Council. It is not known at this time how much, or in which fiscal years, funds may be applied for, approved, and disbursed.
