STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Three

 

AN ACT relative to vaccination clinics at schools.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Subdivision; School Vaccination Clinics.  Amend RSA 200 by inserting after section 63 the following new subdivision:

School Vaccination Clinics

200:64  School Vaccination Clinics.  

I.  No public elementary or secondary school or chartered public school shall conduct a vaccination clinic at any time during school hours, or within 2 hours of the beginning or end of the school day.

II.  A parent or guardian of the child shall accompany and be present with their child in order for a child to be immunized at a vaccination clinic held in a public elementary or secondary school or chartered public school outside of the hours specified in paragraph I.  

2  Effective Date.  This act shall take effect 60 days after its passage.

METHODOLOGY:

This bill prohibits public elementary, secondary, and charter schools from conducting vaccination clinics during school hours or within two hours of the beginning or end of the school day.  In addition, the bill requires a parent or guardian to be present in order for a child to be immunized at a public school vaccination clinic.  The Department of Health and Human Services assumes the bill will result in a reduction in the number of vaccination clinics conducted in public schools. This may have an indeterminable effect on Department expenditures, as direct and indirect costs related to vaccine and clinic operational costs fluctuate based on demand and access. Additionally, the Department states that school-based clinics satisfy federal Point of Distribution and Strategic National Stockpile training and exercise requirements.  A reduction in the number of clinics may require the Department to secure alternative training and exercise solutions for the state's regional public health networks, at an indeterminable cost.   

 

The Department of Education states the bill will have no fiscal impact.
