STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Three

 

AN ACT relative to prohibiting the department of health and human services from enforcing salary caps for direct care workers.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Section; Services for the Developmentally Disabled; Prohibiting Salary Limits.  Amend RSA 171-A by inserting after section 1-d the following new section:

171-A:1-e  Prohibiting Salary or Hourly Wage Limits.  The department shall not establish or enforce, in statute or rule, a limit or cap on the salary or hourly wages of direct support staff.  The department shall use existing budget appropriations to negotiate reasonable wages and appropriate service budgets with area agencies and service providers.

2  Effective Date.  This act shall take effect 60 days after its passage.
