AN ACT establishing a committee to study the medical screening panel process and temporarily pausing the screening panel process.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Three

 

AN ACT establishing a committee to study the medical screening panel process and temporarily pausing the screening panel process.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Committee Established.  

I.  There is established a committee to study screening panels for medical injury claims.  The members of the committee shall be as follows:

(a)  One member of the senate, appointed by the president of the senate.

(b)  Three members of the house of representatives, appointed by the speaker of the house of representatives.

II.  Members of the committee shall receive mileage at the legislative rate when attending to the duties of the committee.

III.  The committee shall study RSA 519-B, relative to screening panels for medical injury claims and assess the following:

(a)  Whether the current medical screening panel statute is achieving the intended purposes.

(b)  Whether there is a way to structure the medical screening panel process to better achieve its intended purposes.

(c)  Whether RSA 519-B should be amended or repealed.

IV.  The members of the study committee shall elect a chairperson from among the members.  The first meeting of the committee shall be called by the first-named senate member.  The first meeting of the committee shall be held within 45 days of the effective date of this section.  Four members of the committee shall constitute a quorum.

V.  The committee shall report its findings and any recommendations for proposed legislation to the president of the senate, the speaker of the house of representatives, the senate clerk, the house clerk, the governor, and the state library on or before November 1, 2023.

2  Screening Panels for Medical Injury Claims; Temporary Suspension.

I.  Beginning July 1, 2023, the medical screening panel process pursuant to RSA 519-B shall be suspended and no action for a medical injury shall be assigned to a screening panel.

II.  Any action for medical injury filed in superior court prior to July 1, 2023 shall not be affected by this suspension.  Any such action filed prior to July 1, 2023 shall be subject to the medical screening panel process provided for in RSA 519-B.

3  Repeal.  Section 2 of this act, relative to a temporary pause on medical screening panels, is repealed.

4  Effective Date.  

I.  Section 2 of this act shall take effect July 1, 2023.

II.  Section 3 of this act shall take effect July 1, 2024.

III.  The remainder of this act shall take effect upon its passage.
