Amendment to HB 1151

 

Amend the title of the bill by replacing it with the following:

 

AN ACT relative to the carrying of alcoholic beverages on hotel premises and monthly deposits from the liquor commission to the general fund.

 

Amend the bill by replacing all after the enacting clause with the following:

 

1  New Paragraphs; Restrictions on Serving and Congregating of Patrons.  Amend RSA 179:27 by inserting after paragraph II the following new paragraphs:

III. Stages or designated performing areas and areas designated for entertainers may be approved areas of service.

IV. Notwithstanding paragraphs I and II, a hotel guest may purchase an alcoholic beverage, or bottle of wine, at a hotel lounge, as described in RSA 178:22, V(k) or hotel full-service restaurants as described in RSA 178:21, II(b) and may carry the alcoholic beverage or partially consumed bottle of wine from the lounge or dining room to the guest’s room. For the purposes of this paragraph, the number of alcoholic beverages shall be limited to the number of registered guests to that room who are 21 years of age or older. For the purposes of this paragraph, any partially consumed bottle of wine shall be securely sealed.

2  The Liquor Commission; Funds.  Amend RSA 176:16, I to read as follows:

I. Except as provided in paragraph II, the state treasurer shall credit all gross revenue derived by the commission from the sale of liquor, or from license fees, and interest received on such moneys, to a special fund, to be known as the liquor commission fund, from which the treasurer shall pay all expenses of the commission incident to the administration of this title. Any balance left in such fund after such expenses are paid shall be deposited in the general fund on a [daily] monthly basis.

3  Effective Date.  This act shall take effect 60 days after its passage.

AMENDED ANALYSIS

 

This bill allows a guest of a hotel to purchase a drink at a hotel bar or restaurant and carry it back to the guest's room.

 

This bill also requires the liquor commission to make a monthly deposit to the general fund.
