This bill requires that persons or entities acquiring a permit for timber harvesting operations in wetlands obtain and maintain in their records all permitting documents required for the work being done.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Four

 

AN ACT relative to permitting notification required before harvesting trees in a wetland.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Paragraph; Timber Harvesting; Operations in Wetlands.  Amend RSA 227-J:6 by inserting after paragraph III the following new paragraph:

IV.  Any person or entity acquiring a permit for timber harvesting operations in wetlands as described in paragraphs I or II shall maintain in their records all permitting documents required by state law, as well as any permits or records required by municipal ordinances, prior to any tree harvesting work commencing.  The landowner, landowner agent, or any other entity having decision-making authority for such harvesting operations in wetlands is responsible for obtaining such permits required for the work being done and maintaining availability of such records.  Failure to comply with these requirements may result in penalties under RSA 482-A.

2  Effective Date.  This act shall take effect 60 days after its passage.
