AN ACT relative to review by the advisory council on child care of child care center licensing violations.

This bill provides for an opportunity for the advisory council on child care to review the department of health and human services' decisions involving child day care licensing violations.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Four

 

AN ACT relative to review by the advisory council on child care of child care center licensing violations.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Child Day Care Licensing; Notice and Hearing.  Amend RSA 170-E:13, II to read as follows:

II. Any applicant, licensee or permittee aggrieved by a decision of the department to suspend, revoke, deny or refuse to renew a license or permit may appeal to the commissioner. For purposes of carrying out the provisions of this section, the commissioner may, in accordance with the rules adopted by the department of personnel pursuant to RSA 541-A, appoint a hearings officer or officers, as necessary, to preside over such hearings. A hearings officer may affirm, deny or modify the decision of the department. The commissioner shall adopt rules, pursuant to RSA 541-A, relative to procedures for the appeal process provided under this paragraph.  Such procedures shall include the opportunity for review of the department's decision by the advisory council on child care established under RSA 126-A:17.  Review by the advisory council shall be at the request of the applicant or licensee.  Findings and recommendations of the advisory council shall be presented to the hearings officer prior to issuance of a final decision.

2  New Subparagraph; Advisory Council on Child Care; Review of Licensing Decisions.  Amend RSA 126-A:17, V by inserting after subparagraph (g) the following new subparagraph:

(h)  Reviewing department decisions regarding child day care licensing violations pursuant to RSA 170-E:13, II.

3  Effective Date.  This act shall take effect 60 days after its passage.
