ANALYSIS
This bill requires institutions of higher education approved by the higher education commission for degree granting authority to be organized as nonprofit organizations and to comply with the Higher Education Act and state and federal anti-discrimination laws.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twenty Four
AN ACT relative to degree granting authority of certain institutions of higher education.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Paragraph; Higher Education Corporations; Granting of Degrees. Amend RSA 292:8-h by inserting after paragraph II the following new paragraph:
II-a. Any institution approved by the higher education commission under paragraph II shall be a non-profit organization exempt from taxation under section 501(c)(3) of the Internal Revenue Code and comply with all provisions of the institutional eligibility standards of the Higher Education Act of 1965, as amended, 34 CFR part 600, and all applicable state and federal anti-discrimination laws.
2 Effective Date. This act shall take effect 60 days after its passage.
