Relative to rebates of energy efficiency funds for electric vehicles.

Amendment to HB 1472-FN


Amend the bill by replacing all after the enacting clause with the following:


1  Regional Greenhouse Gas Initiative; Energy Efficiency Fund and Use of Auction Proceeds.  Amend RSA 125-O:23, II to read as follows:

II. [All] From amounts received in excess of the threshold price of $1 for any allowance sale, $1,500,000.00 shall be transferred to the department of revenue administration for the fiscal year ending June 30, 2026, and $1,500,000.00 shall be transferred for the fiscal year ending June 30, 2027 for use as provided in paragraph II-a, and all other such amounts received shall be rebated to all retail electric ratepayers in the state on a per-kilowatt-hour basis, in a timely manner to be determined by the commission.

II-a.  The department of revenue administration shall develop and implement a so-called "cash on the hood" program for point-of-sale electric vehicle rebates to buyers.  The program shall initially be a 2-year pilot program ending June 30, 2027.

2  New Section; Multiple Pollutant Reduction Program; Electric Cars; Rulemaking.  Amend RSA 125-O by inserting after section 125-O:23 the following new section:

125-O:23-a  Electric Car Rebate Pilot Program; Rulemaking.

In order to implement the pilot program established under RSA 125-O:23, II-a, the commissioner shall adopt rules, pursuant to RSA 541-A, relative to:

I.  Eligible Vehicles.  New or used battery electric vehicles (BEV) and plug-in hybrid electric vehicles (PHEV) purchased from a licensed New Hampshire dealership by a New Hampshire resident with a price of no more than the amounts listed below, where the price is defined as total MSRP or “sticker price,” including options and accessories, minus destination or delivery charges, and excluding all other discounts, deductions, credits or rebates: $80,000 for pickup trucks, sport utility vehicles (SUV) or commercial vans, $50,000 for all other eligible vehicles.  

II.  Incentive Amounts.  For new and used eligible vehicles the incentive amounts shall be $2,000 for a battery electric vehicle (BEV) and $1,000 for a plug-in hybrid electric vehicle.  

III.  Individual New Participant Eligibility.  Only one incentive payment per vehicle per calendar year is available to New Hampshire residents that must be at least 18 years of age, with a current, valid New Hampshire driver’s license.  A temporary license is acceptable.  The participant must have a modified adjusted gross income as reflected on their most recent federal income tax return of $150,000 for married couples filing jointly, $112,500 for heads of households, and $75,000 for all other filers.

IV.  Program Administration:

(a)  Upon the purchase or lease of eligible vehicles by an eligible participant the dealership shall confirm the vehicle eligibility and provide them with the necessary paperwork to either apply for and receive a rebate themselves or transfer that rebate directly to the dealership.

(b)  An online portal shall be made available for participants and dealerships to facilitate the request and transfer of the rebate within 72 hours after the request is processed.

(c)  Any taxpayer deemed ineligible shall be held responsible for reimbursement to the state.  

V.  Reporting.  The department shall submit to the speaker of the house, president of the senate and chairperson and ranking minority member of the house science, technology and energy and senate energy and natural resources committees a detailed report indicating the results of the pilot program including, but not limited to what portion of the allocated funds were applied to offset administrative costs incurred by the department.

3  Repeal.  RSA 125-O:23-a, relative to rulemaking for the electric car rebate pilot program, is repealed.

4  Effective Date.  

I.  Section 3 of this act shall take effect July 1, 2027.

II.  The remainder of this act shall take effect July 1, 2025.
