STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twenty Four
AN ACT relative to the prescription drug affordability board.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Drug Affordability Board; Executive Director. Amend RSA 126-BB:2, VI to read as follows:
VI. The board shall be administratively attached to the department of health and human services. [For a limited time,] The board may employ an executive director, who shall be an unclassified employee. The executive director shall be appointed by and serve at the pleasure of the board. [Said position shall be effective for no more than 2 years following the date of hire of the individual first selected to fill the position]. The board may also employ one contracted employee or more, dependent on the availability of funds.
2 Drug Affordability Board Administration Fund; Transfer of Permit Fees. Amend the section heading of RSA 126-BB:8 and RSA 126-BB:8, I to read as follows:
126-BB:8 Funding; [General Funds and] Administration Fund; Voluntary Contributions.
I. The expenses and cost of operation of the board shall be funded [by general funds or] by voluntary contributions deposited in the board's dedicated fund and by the transfer into the fund established in paragraph II an amount determined by the board of pharmacy as 50 percent, but not less than $750, of each permit issued by the New Hampshire board of pharmacy to a manufacturer, distributor, or wholesaler under RSA 318. The governor is authorized to draw a warrant for the transfer of said sums out of any money in the treasury.
3 Contract Approval. Amend RSA 126-BB:11 to read as follows:
126-BB:11 Competitive Bid Required. The contracts entered into by the board, including those for consulting services or personal contract services, shall be subject to the competitive bid process. Such contracts shall also be approved by the [fiscal committee of the general court, the] governor[,] and the executive council.
