1 New Section; Oversight and Review of Department Employees. Amend RSA 126-A by inserting after section 3 the following new section:
126-A:3-a Oversight and Review of Department Employees. The commissioner shall direct the department to adopt rules that require all employees who have been found, by virtue of a complaint filed in the normal course, to have failed to perform their jobs properly, according to their job descriptions and duties, to submit to a thorough job review. Where an employee manages cases as part of the employee's duties, the job review shall include a case review. The review shall encompass a detailed examination of the all of the records related to their job performance, including their responses to delegated tasks, for the prior 3 years. If the examination reveals a pattern of failure to perform their duties as required, the employee shall be placed on probation and receive remedial training. In the event that an employee has a pattern of putting lives at great risk, the employee shall be terminated. The commissioner is directed to require that all administrative rules that contradict this section be amended or repealed.
2 Effective Date. This act shall take effect January 1, 2025.
