1 Chartered Public Schools; Definitions. Amend RSA 194-B:1, IV to read as follows:

IV. "Chartered public school" means an open enrollment public school, operated independent of any school board and managed by a board of trustees. A chartered public school shall operate as a nonprofit secular organization under a charter granted by the state board and in conformance with this chapter.

2 Chartered Public Schools; Establishment. RSA 194-B:3, III(a) is repealed and reenacted to read as follows:

(a) Chartered public schools authorized pursuant to this chapter shall meet the following criteria:

(1) Are not affiliated with or espouse any specific religious denomination, organization, sect, or belief and do not promote or engage in any religious practices in their educational program, admissions, employment policies, or operations;

(2) Are not affiliated with any organization or group in violation of state of federal anti-discrimination laws.

3 Chartered Public Schools; Eligibility. Amend RSA 194-B:3, V(a) to read as follows:

(a) A nonprofit organization including, but not limited to, a college, university, museum, service club, or similar entity.

4 Chartered Public School Approved by State Board of Education. Amend RSA 194-B:3-a, V(a)(2) to read as follows:

(2) RSA 194-B:3, III -IV.

5 Effective Date. This act shall take effect July 1, 2024.

A chartered public school is a private corporation, incorporated under the laws of New Hampshire, and shall operate as a nonprofit secular organization and 501(c)3 corporation under a charter granted by the state board and in conformance with this chapter.
