1 Substantive Educational Content of an Adequate Education; Approval of Alternative Programs. Amend RSA 193-E:2-a, V(b) to read as follows:
(b) The state board of education shall adopt rules, pursuant to RSA 541-A, relative to the approval of alternative programs for granting credit leading to graduation.
2 Effective Date. This act shall take effect 60 days after its passage.

1 Substantive Educational Content of an Adequate Education; Approval of Alternative Programs. Amend RSA 193-E:2-a, V(b) to read as follows:
(b) The state board of education shall adopt rules, pursuant to RSA 541-A, relative to the approval of alternative programs for granting credit leading to graduation.
(1) A for-profit or non-profit entity that offers an educational program approved under this section shall have policies that are required of school districts and charter schools set forth underRSA 193:39.
(2) An ad hoc committee shall evaluate the application for an alternative program. The committee shall consist of the following members:
(A) The administrator of the office of academics and professional learning (OAPL), or designee, who shall serve as chair of the committee, appointed by the commissioner;
(B) A department representative with content area expertise, curriculum competency expertise, or both, appointed by the commissioner;
(C) A representative from the extended learning opportunity network, appointed by the director of the extended learning opportunity network; and
(D) Two New Hampshire state board licensed teachers licensed in the content area enumerated on the application, currently teaching in that content area in a school, as defined in Ed 1402.01(h), appointed by the director of the New Hampshire School Administrators Association.
(3) The state board of education shall annually review all entities that offer an educational program approved under this section for continued compliance with all state and federal anti-discrimination laws, including any policies mandated by this section.
