STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twenty Four
AN ACT relative to review of education freedom account service providers.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Paragraph; Education Freedom Account Service Providers; Review. Amend RSA 194-F:6 by inserting after paragraph II the following new paragraph:
III. Education service providers shall develop and implement policies that are required of school districts and chartered public schools set forth under RSA 193:39. The state board of education shall annually review all education service providers approved under this section for continued compliance with all state and federal anti-discrimination laws, including any policies mandated by this section.
2 Effective Date. This act shall take effect 60 days after its passage.

METHODOLOGY:
This bill, assumed to be effective in FY 2025, requires each service provider in the education freedom account (EFA) program to develop a policy that implements a plan to prevent, intervene and respond to incidents of discrimination and shall have the State Board of Education annually review all education service providers for continued compliance with this law. Education service providers are currently required to comply with all state and federal anti-discrimination laws according to RSA 194: F-6, II (c). The Department of education states there would be a cost for the State to review all the education service providers for continued compliance with the provisions of this bill. The Department has not provided a cost estimate (or range of potential cost) attributable to this bill.
The EFA program, as of December 4, 2023, has 1,301 approved education service providers and there are new providers continually being added.
