STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Four

 

AN ACT relative to restricting data sharing through the state immunization registry.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Paragraph; State Immunization Registry; Data Sharing.  Amend RSA 141-C:20-f by inserting after paragraph I the following new paragraph:

I-a. The department shall not share data with any other organization, including but not limited to other state immunization information systems, unless the department is able to assure that withdrawals under paragraph III-a will be honored by that organization. Upon specific notarized request by a patient, or the patient’s parent or guardian if the patient is a minor, immunization records may be shared with a non-compliant entity.

2  Effective Date.  This act shall take effect 60 days after its passage.

METHODOLOGY:

This bill prohibits the Department of Health and Human Services from sharing data from the NH Immunization Information System (NHIIS) with other organizations unless withdrawals will be honored by that organization.  The Department states that while the NHIIS does not currently send data to other state immunization information systems, the existing technology platform lacks the capacity to share information selectively; instead, it is configured to share all allowable information, should the Department enter into a data-sharing agreement with another entity. Accordingly, the Department states that a one-time enhancement to the platform would be needed to implement the bill, at an estimated cost of $3 million.  An additional one-time enhancement, estimated at approximately $70,000, would be needed to implement a customized transmission log report.  Finally, the Departments states it would need additional staff resources to develop, implement, and process log reports and withdrawals from other state or jurisdictional immunization information systems.  The Department estimates the cost of these positions as follows:
