ANALYSIS

 

This bill prohibits the department of health and human services from sharing data from the state immunization registry with other organizations unless the department can assure withdrawals from the registry will be honored by the organization.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Four

 

AN ACT relative to restricting data sharing through the state immunization registry.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Paragraph; State Immunization Registry; Data Sharing.  Amend RSA 141-C:20-f by inserting after paragraph I the following new paragraph:

I-a. The department shall not share data with any other organization, including but not limited to other state immunization information systems, unless the department is able to assure that withdrawals under paragraph III-a will be honored by that organization. Upon specific notarized request by a patient, or the patient’s parent or guardian if the patient is a minor, immunization records may be shared with a non-compliant entity.

2  Effective Date.  This act shall take effect 60 days after its passage.
