Floor Amendment to HB 1698-FN

 

Amend RSA 430:34-a, IV as inserted by section 1 of the bill by replacing it with the following:

 

IV.(a)  Except as provided in subparagraph (b), this section shall not apply to the aerial application of pesticides by a person possessing a valid certificate of registration or permit pursuant to RSA 430:33 while applying pesticides for agricultural purposes using unmanned aircraft as defined in RSA 422:3, XXX at a height not exceeding 20 feet above ground level.

(b)  A person possessing a valid certificate of registration or permit pursuant to RSA 430:33 and using an unmanned aircraft to apply pesticides shall notify beekeepers registered with the department of agriculture, markets, and food, located within 200 feet of the proposed treatment area at least 14 days but not more than 60 days before the commencement of the intended spray applications.  Notification shall be by United States mail and shall contain the information listed in subparagraphs II(a)-(h).

AMENDED ANALYSIS

 

This bill exempts the application of pesticides using drones from notification procedures, except in cases where a registered beekeeper has an apiary within 200 feet of the proposed application area.
