STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twenty Three
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Subdivision; Services for the Developmentally Disabled; Commission to Study Transitioning to a 2-tier Waiver System for Individuals Eligible for Disability Services. Amend RSA 171-A by inserting after section 34 the following new subdivision:
Commission to Study Transitioning to a 2-tier Waiver System
for Individuals Eligible for Disability Services
171-A:35 Commission to Study Transitioning to a 2-tier Waiver System for Individuals Eligible for Disability Services. There is established a commission to study transitioning to a 2-tier waiver system for individuals eligible for disability services.
I. The members of the commission shall be as follows:
(a) Four members of the house of representatives, appointed by the speaker of the house of representatives, 2 of whom shall be nominated by the leader of the minority party. Two members shall be from the health and human services committee and 2 members shall be from either the finance committee or ways and means committee.
(b) Two members of the senate from the health and human services committee, appointed by the president of the senate, one of whom shall be nominated by the leader of the minority party.
(c) The legislative budget assistant, or designee.
(d) The director of the bureau of development services, or designee.
(e) An expert in disability service program design, appointed by the governor.
(f) Two representatives of area agencies, nominated by the executive directors of the area agencies and appointed by the governor.
II. Legislative members of the commission shall receive mileage at the legislative rate when attending to the duties of the commission.
III. The commission shall study the feasibility of transitioning from the current single waiver to a 2-tiered waiver system and other recommendations from review of the New Hampshire developmental disabilities service system by Alvarez and Marshal - Public Sector Services (A&M).
IV. The members of the commission shall elect a chairperson from among the members. The first meeting of the committee shall be called by the first-named house member. The first meeting of the committee shall be held within 45 days of the effective date of this section. Six members of the committee shall constitute a quorum.
V. The commission shall issue an interim report and a final report of its findings and any recommendations for proposed legislation to the president of the senate, the speaker of the house of representatives, the chairs of finance and ways and means in the house of representatives and the senate, the senate clerk, the house clerk, the governor, and the state library. The interim report shall be submitted on or before November 1, 2023 and the final report on or before November 1, 2024.
2 Repeal. RSA 171-A:35 and the subdivision heading preceeding RSA 171-A:35, relative to the commission to study the potential of transitioning to a 2-tier waiver system for those eligible for disability services, are repealed.
I. Section 2 of this act shall take effect November 1, 2024.
II. The remainder of this act shall take effect upon its passage.
