STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twenty Three
AN ACT relative to protective services for vulnerable adults and the definition of abandonment.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Paragraph; Protective Services to Adults; Definitions; Abandonment. Amend RSA 161-F:43 by inserting after paragraph II the following new paragraph:
II-a. "Abandonment" means an act or instance of leaving a person who, for the purposes of this chapter, is vulnerable and dependent on another person to assist them when being discharged from a health care facility. Abandonment could include a person who is documented as the next of kin or family member refusing to provide assistance in complying with the discharge orders from a health care facility.
2 Effective Date. This act shall take effect 60 days after its passage.
