Floor Amendment to SB 263-FN
Amend the title of the bill by replacing it with the following:
AN ACT relative to the New Hampshire granite advantage health care program and the commission to evaluate the effectiveness and future of the New Hampshire granite advantage health care program.
Amend the bill by inserting after section 7 the following and renumbering the effective date to be the last numbered section:
8 New Paragraph; New Hampshire Granite Advantage Health Care Program; Drug Testing Requirement. Amend RSA 126-AA:2 by inserting after paragraph VII the following new paragraph:
VII. Any person eligible for the program shall agree to participate in semi-annual drug testing. To the extent permitted by federal law and the state Medicaid plan, the commissioner of the department of health and human services shall institute a drug testing program for all granite advantage health care participants.
(a) The commissioner shall deny, or otherwise deem ineligible, any individual who twice fails a drug test for illegal consumption of any illegal drugs/controlled substances or prescription drugs not prescribed by his or her doctor. This subparagraph shall not apply to any person who is actively participating in a substance abuse program approved by the governor's commission on alcohol and drug abuse prevention, treatment, and recovery, established under RSA 12-J.
(b) The commissioner shall be responsible for ensuring the confidentiality of any and all drug test results administered as part of the program. Drug test results shall only be used for the purpose of determining continued program participation. At no time shall drug test results be released to any public or private person or entity.
(c) The commissioner shall adopt rules, under RSA 541-A, relative to the implementation and administration of the drug testing program.

AMENDED ANALYSIS
This bill:
I. Reestablishes and revises the membership and duties of the commission to evaluate the effectiveness and future of the New Hampshire granite advantage health care program. The commission is repealed November 1, 2028.
II. Permanently extends the New Hampshire granite advantage health care program by removing the prospective repeal of the program that was to take effect on December 31, 2023.
III. Removes the transfer of funds from the alcohol abuse prevention and treatment fund to the granite advantage health care trust fund.
IV. Requires program participants to submit to semi-annual drug testing as part of the granite advantage health care program.
